Terms of Service

BLD Hosting, here forth referred to as the “Provider”, introduces a worldwide set of services. The Provider allows the public to freely purchase and utilize these mentioned services, however; its clients, the users, are to abide by the regulations of this agreement. Infringement may result in immediate termination, suspension, or even a fee.

Illegal use
The Provider’s servers may not contain any illegal content. This includes, but is not limited to:

- Unauthorized distribution or copying of copyrighted software or other data
- Harassment
- Phishing
- Fraud
- Warez on servers
- Hate groups
- Nazi forward organizations
- Racism
- IRC networks (applets are allowed).
- Child pornography
- Illegal “black hat” hacking, and
- Anything that may be deemed illegal by the U.S and Canadian government

In the case of infringement, accounts will be suspended without prior warning. Backups will NOT be provided.

Spam
The Provider’s services may not be used for anything that is essentially spamming. The use of this frowned upon action will result in an immediate termination.

Billing
The Provider offers four different payment terms; monthly, semi-annually, annually, and biennially. The 30 day money back guarantee applies to the first thirty days of registration only. Upon the expiration of the refund policy, money will not be compensated if a payment term is cut short.

If customer A were to order Plan B on an annual cycle, and customer A decides to stop using the service after 4 months, under this agreement, he will NOT be compensated for the remaining 8 months.

Once an invoice becomes overdue, the Provider reserves the right to suspend the service after 3 days, and then terminate the service after a total of 10 days, if payment is still not received.

Accounts removed due to a violation of this agreement, will not be subject to a refund.

All overdue invoices will be charged a 10% late fee.

Money Back Guarantee
The 30 Day Money Back Guarantee is split into two major sections; requests before the first 14 days, and requests afterwards. The first 14 days is referred to as the "Trial Period". During this time, a client may request for a refund at any time, and there will be no questions asked. No prior reason must be mentioned. The 14th day marks the end of the Trial Period. At this time, clients are still liable for a refund (until the 30th day), however; users must submit a valid reason.

This Money-Back-Guarantee is not applicable to Dedicated Server sales. Please see "Refunds" for more information.

Indemnification
Under this agreement, the customer indemnifies the Provider for any violation of this Terms of Service (ToS) that results in loss to the Provider or the bringing of any claim against the Provider by any third-party.

This means that if any legal action is used against the Provider because of a customer's or a customer of a customer's activity, the customer will pay any damages awarded against the Provider, plus all legal fees assumed by the Provider.

Backups
Although the Provider schedules a daily backup, they are created for the sole purpose of internal use. These will not be provided publicly.

Responsibility for Content
You, as the Provider's customer, are solely responsible for the content stored on and served by your account.

Server Abuse
The Provider reserves the right to suspend, terminate or charge any account that may be deemed as a “Resource Hog”. While this process is not automated, server health is on the daily checklist. Accounts utilizing more than their designated resources, including CPU and memory usage, will be warned, suspended, or a combination. Failure to comply will result in an immediate termination.

The Provider reserves the right to deem users as “Resource Hogs”.

Data Transfer Limit
All users are allocated a monthly Transfer allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more Data Transfer is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused Transfer in one month cannot be carried over to the next month.

Shared Hosting
Shared accounts are not to resell services to other clients. Such actions are meant for resellers only.

Price Change
The price you pay for your service will never increase from the date of purchase. We, however; reserve the right to change pricing listed on our website, and the right to alter plan specifications at any time.

Domain Name
The free domain name service - accompanied by the business or corporate hosting packages - are not property of the client until their sixth invoice has been paid in full. By the purchase of such a package, you agree to these terms of service. The Provider is given full rights and ownership to the domain until this six month period.

Disclaimer
The Provider shall not be responsible for any damages your business may suffer. We make no warranty of any kind, expressed or implied for services we provide. The Provider disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by BLD Hosting and its employees.

Disclosure to law enforcement
The Provider may disclose any user information to law enforcement agencies without further consent or notification to the user upon lawful request from such agencies. We will cooperate fully with law enforcement agencies.

Bandwidth
The Provider agrees that it shall maintain a 100Mbps connection to each server (from the server to the switch). However, The Provider does not warrant any response rate or download time beyond it’s control, as this is depending on Customer’s and End Users ISP connections. We do NOT guaranty a set internet speed to your server. We do recommend, however, that you take advantage of our “speed and ping” test, prior to placing your order with BLD Hosting. All decisions are recommended to be accompanied by such a test. This holds true for Shared Hosting, VPS Hosting, and even, Dedicated Servers.

Refunds
We always try our best to give our customer(s) outstanding equipment, support and the best pricing for these services. However, occasionally this is not enough to satisfy all. If you are seeking a refund from The Provider, you will need to adhere to the following in order to make this process work for both the customer and BLD Hosting:

1. Notify The Provider with your concern(s), question(s), and complaint(s) in writing (via email). Allow 48 hrs for a response from The Provider. If your question(s), concern(s), or complaint(s) are extremely pressing, PLEASE contact BLD Hosting directly and speak with Customer Service. If your complaint is regarding bandwidth and speed we will immediately ask you if you have performed our free speed test and ping test. By your acceptance of these terms and conditions, you will have agreed to the using of this free testing system to see if our services meet your current needs. If you have not taken advantage of our free speed test and ping test, then you do so at your own volition. Either way, The Proivder will NOT refund your first month(s) payment if you decide that bandwidth and speed is an “issue” for you. After all… unlike most web hosting companies, The Proivder DOES NOT charge a set-up fee and must pay staff to build, connect and configure your server(s) and provide support, when you place your order(s) with BLD Hosting.

2. If you have a question concerning our terms of service, please contact us prior to placing your order(s) with BLD Hosting. Whenever you decide to place your order(s) with The Provider, please ask the staff for an approximate set-up time for your server. At times, due to heavy ordering and our fantastic pricing, we cannot get equipment delivered fast enough to meet this same demand. If the set-up time does not meet your needs, PLEASE do not place your order(s) with BLD Hosting. We are not the Post Office or UPS and sometimes cannot control how fast our vendors get our equipment shipped to us.

3. If you are requesting a refund for an unknown reason and have not placed your request to BLD Hosting either by writing (via email), OR by directly contacting The Provider's customer service department, but, have contacted either your credit card company or paypal directly - this may result in a DELAY of your refund. Since both entities will place a HOLD on your money until they investigate your complaint, this takes the refund process “out of the hands” of The Provider’s control and may cause a delay on your refund. We ask that you please contact The Provider’s customer service department directly at support@bldhosting.net to place your request for a refund.

Modification
The Provider reserves the right to add, delete, or amend these terms and conditions at any time without prior notice.
